Objectives and competences

Objectives

The course provides an overview of the theory and practice of constitutional rights in Europe and the US. Constitutional rights are conceptualized and guaranteed differently in these two diverse legal cultures, differing significantly in the depth of their political decentralization, the impact of federal regulations on various aspects of the law and their interaction with international law. The programme shows how constitutional challenges are related to the character of the civil or common law of each legal system, and how these challenges can best be resolved by understanding their historical and theoretical foundations.
